High Court of Rajasthan

• The judicial system in Rajasthan is structured around the Rajasthan High Court, which serves as the apex court for the state.
• The Rajasthan High Court, established on 21 June 1949 under the Rajasthan High Court Ordinance, 1949, has its principal seat in Jodhpur and a bench in Jaipur.
• The state is divided into 35 Judgeships, including 388 District Judge Cadre courts, 319 Senior Civil Judge Cadre courts, and 438 Civil Judge Cadre courts.
• Chief Justices of the Rajasthan High Court:
  • The first Chief Justice of the Rajasthan High Court was Kamala Kant Verma.
  • The current Chief Justice is Mr. Indrajit Mahanty.
• The administrative and judicial functions of the Rajasthan High Court are governed by the Rajasthan High Court Rules 1952, which are periodically amended to ensure efficient operations.

District Courts in Rajasthan

• Under the Rajasthan High Court, there exists a hierarchy of courts known as subordinate courts, as outlined in the Indian constitution. These subordinate courts are categorized into two types: District Courts and other courts.
• The state is divided into districts, each of which has a district court with appellate jurisdiction within its district. These district courts are administratively controlled by the High Court. Currently, there are 36 District and Sessions Courts in Rajasthan within the lower judiciary.

Sub-Ordinate Courts in Rajasthan

• In each district of India, there are various subordinate or lower courts, including civil courts, criminal courts, and revenue courts. Civil courts handle civil cases, criminal courts address criminal cases, and revenue courts deal with revenue cases. The District Judge, located at the district headquarters, has the authority to try both civil and criminal cases and is therefore known as the District and Sessions Judge.
  
• Beneath the district courts, there are several lower courts, such as the Additional District Court, Sub-Court, Munsiff Magistrate Court, Court of Special Judicial Magistrate of the II Class, Court of Special Judicial Magistrate of the I Class, and Court of Special Munsiff Magistrate for Factories Act and Labour Laws.
• At the lowest level of the hierarchy of Subordinate Courts are the Panchayat Courts (e.g., Nyaya Panchayat, Panchayat Adalat). These are not considered part of the criminal courts jurisdiction. Most civil cases are filed in the Munsif Court, and appeals from the Munsif Court can be made to the Sub-Judge or Additional Sub-Judge.
