It is uncertain whether India and the US are signing a new extradition treaty or amending the existing one. However, it is evident that western democracies have generally turned down India's extradition requests. When India sought the extradition of Amanullah Khan, a leader of the JKLF, during his visit to the US, the request was denied by a US law court. A similar outcome occurred when Khan went to Belgium. The refusal to extradite individuals is often based on two grounds: if the offense is deemed to be of a political nature or if the individual would not receive a fair trial in India. Unfortunately, India's human rights record has been criticized, leading to judges in the US and Europe sympathizing with fugitives sought for extradition. Several cases, including those of Karamjit Singh Chahal and the Sikh terrorists Sukhwinder Singh Sandhu and Ranjit Singh Gill, exemplify the complex and lengthy processes involved in India's extradition attempts. The passage also highlights the failure to bring Warren Anderson, the Union Carbide chief, to trial for the Bhopal gas tragedy.
