- धारा 377 की शुरुआत लॉर्ड मेकाले ने 1861 में की थी | इसके तहत समलैंगिकता अपराध की श्रेणी में था | धारा-377 भारत में अंग्रेजों ने 1862 में लागू किया था | इस कानून के तहत अप्राकृतिक यौन संबंध को गैरकानूनी ठहराया गया है |
- इंडियन पीनल कोड की धारा 377 के अनुसार “ किसी भी व्यक्ति , महिला या जानवर के साथ स्वैच्छिक रूप से संभोग करने वाले व्यक्ति को अपराधी माना जाएगी और उसे आजीवन कारावास की सजा या दस साल तक के कारावास की सजा हो सकती है और जुर्माना भी लगाया जा सकता है |
- समलैंगिकता की इस श्रेणी को LGBTQ (लेस्बियन, गे, बाइसेक्सुअल, ट्रांसजेंडर और क्वीयर) के नाम से भी जाना जाता है| इसी समुदायों के लोग काफी लंबे समय से भारतीय दंड संहिता (Indian Penal Code) के तहत इस धारा में बदलाव कराने और अपना हक पाने के लिए सालों से लड़ाई लड़ रहे थे |
