  • No forfeiture for simple misconduct; requires specific circumstances

4.4 Nomination and Payment

  • Employee may nominate person(s) to receive gratuity in case of death
  • If no nomination, payment to legal heirs in order: spouse, children, parents, other heirs
  • Gratuity exempt from attachment in execution of decree/order of court
  • Controlling authority may direct payment if employer fails to pay within 30 days

5. Workmen's Compensation Act, 1923

5.1 Basic Framework

  • Above 60 years: Factor 106.04 to 90.91

5.4 Procedure and Authorities
