Constitutional Articles on Council of Ministers

What needs to be memorized: Articles 74, 75, 77, and 78 (Note: Article 76 is NOT about Council of Ministers - it's about Attorney General)

Mnemonic: "Sachin's Council innings: 74, 75 maare, 76 miss kiya, phir 77, 78!"

What needs to be memorized: A minister who is not a member of Parliament must get elected to either House within 6 months, otherwise ceases to be a minister

Mnemonic: "Half-year homework - Minister ban gaye? Chheh mahine mein MP bhi ban jao, warna OUT!"

  • Half-year (6 months) → Maximum time limit given
  • Homework → Must get elected to Lok Sabha or Rajya Sabha
  • OUT → Ceases to be a minister if deadline missed

Collective Responsibility (Article 75)

What needs to be memorized: Council of Ministers collectively responsible to Lok Sabha - includes solidarity (swim or sink together), secrecy of decisions, collective decision-making, and resignation together if confidence lost

Mnemonic: "Team India cricket ki tarah - Saath khelte, Saath jeette, Saath harte, Strategy secret, Lok Sabha = Cricket audience ko khush karna padta hai!"

  • Saath khelte → Work together in solidarity, collective decision-making
  • Saath jeette/harte → Swim or sink together, all resign if no-confidence motion passed

What needs to be memorized: Three key duties - (1) Communicate all Council decisions, (2) Furnish information on demand, (3) Submit individual ministerial decisions to Council if President requires

Mnemonic: "PM = President ka CIF Reporter"

Two Types of Ministerial Oath

What needs to be memorized: Every minister must take two oaths before assuming office - Oath of Office and Oath of Secrecy

Mnemonic: "Double OS - Operating System ki tarah: Office chalana + Secrets rakhna"

  • OOath of Office (faithfully discharge duties, uphold Constitution and law)

Mnemonic: "PPP Formula - President's Pleasure (paper mein), PM's Pleasure (practical mein)"

  • First P (President's Pleasure) → Constitutional provision (Article 75)
  • Second P (PM's Pleasure) → Real/practical situation
  • Third P (PM's advice) → President bound to act on PM's advice, so PM decides who stays/goes

💡 Memory Tip: Like in school - Principal can technically remove anyone (President's power on paper), but in practice Head Teacher/Vice-Principal decides (PM's real power)!

Size of Council of Ministers

What needs to be memorized: 91st Constitutional Amendment (2003) capped the size at 15% of total strength of Lok Sabha (excluding PM)

  • 91st Amendment → Year 2003, introduced size limit
