13 Types of Deductions Permitted from Wages (Section 7)

What needs to be memorized: The Payment of Wages Act permits 13 specific types of deductions: Fines, Absence from duty, Damage or loss of goods, House accommodation, Amenities and services, Recovery of advances, Recovery of loans, Income tax, Provident Fund, ESI (Employee State Insurance), Payments to co-operative societies, Court orders/decrees, and LIC premiums.

Time Limits for Payment of Wages

What needs to be memorized: The deadline for wage payment depends on establishment size: establishments with less than 1,000 workers must pay before the 7th day of the next month; establishments with 1,000 or more workers must pay before the 10th day of the next month.

Mnemonic: "The 7-10 Split Rule - Smaller by 7, Bigger by 10"

  • Below 1000 workers → Payment before 7th day of next month (smaller company = earlier deadline)
  • 1000 or more workers → Payment before 10th day of next month (bigger company = slightly extended deadline)

Limits on Fines and Deductions (Maximum Percentages)

What needs to be memorized: There are three key percentage limits: total deductions cannot exceed 50% of wages; fines and deductions for damage/loss cannot exceed 75% together; a fine for any single breach cannot exceed 3% of wages.

Mnemonic: "The 50-75-3 Protection Rule"

What needs to be memorized: The Act applies to persons employed in: Railway, Factory, Industrial establishments, Tramway service, Motor transport service, Docks/wharves/jetties, Inland vessels (mechanically propelled), Mines/quarries/oilfields, Plantations, and Construction/maintenance establishments.

Mnemonic: "Real Trains Motor to Docks, go Inland; Factories, Industries Mine Plantations for Construction"

  • Trains → Tramway service
  • Motor → Motor transport service
  • Docks → Docks, wharves, jetties
  • Inland → Inland vessels (mechanically propelled)

  • Mine → Mines, quarries, oilfields
  • Plantations → Plantations
  • Construction → Construction or maintenance work establishments

Memory Tip: Visualize a journey across India - you start at a railway station, take various transport (tram, motor, dock, inland vessel) to reach different workplaces (factories, industrial areas, mines, plantations, construction sites). First 5 are mainly TRANSPORT-related, last 5 are PRODUCTION/WORK-related. This covers all 10 types!

Maximum Wage Period

What needs to be memorized: Under the Act, wages must be paid at regular intervals, and the wage period cannot exceed one month.

Mnemonic: "One Month Maximum - OM chant karo!"

Memory Tip: Think of monthly pocket money or monthly salary - it's the standard everywhere! The law says you can't make employees wait more than ek mahina (one month) for their wages. Simple rule: Monthly payment is the maximum gap allowed.

Responsibility for Payment - Who Must Pay Wages

What needs to be memorized: The employer or person responsible for payment of wages must ensure payment (Section 3). If multiple contractors/sub-contractors exist, the principal employer remains ultimately responsible.

Mnemonic: "Boss Bolta Hai - Principal Pays!" (BBH-PP)

  • Principal Employer → Ultimately responsible for ensuring wages are paid
  • Direct Employer → Person responsible under Section 3 for supervision and payment
  • Contractor/Sub-contractor → May make payment but principal remains liable

Memory Tip: Just like in school, the Principal is finally responsible for everything! Even if teachers (contractors) handle day-to-day work, the Principal (main employer) has to ensure salaries are paid. The buck stops at the top - "Principal Pays, Principal Pays!"
