Mnemonics: Muslim Law: Marriage, Divorce, and Maintenance

Essentials of a Valid Muslim Marriage (Nikah)

What needs to be memorized: Proposal and Acceptance (Ijab-Qubul), Competent Parties, Free Consent, Witnesses, No Legal Impediment

Mnemonic: "Please Come Fast - Wedding Notices"

🔗 The Breakdown:

  • Please → Proposal and Acceptance (Ijab-Qubul)
  • Come → Competent Parties (sound mind, age of puberty)
  • Fast → Free Consent (no coercion)
  • Wedding → Witnesses (2 male or 1 male + 2 female)
  • Notices → No Legal Impediment

💡 Think of it like: When you're rushing everyone to come for a wedding, you're essentially checking all the essentials - just like a valid nikah needs all these elements!

Three Categories of Muslim Marriage

What needs to be memorized: Sahih (Valid/Regular), Batil (Void), Fasid (Irregular)

Mnemonic: "Shaadi mein Sab Baatein Final honi chahiye"
(In marriage, all matters should be finalized)

🔗 The Breakdown:

  • Sab → Sahih (Valid/Regular marriage - everything proper)
  • Baatein → Batil (Void marriage - no marriage at all)
  • Final → Fasid (Irregular marriage - has some defects)

💡 Remember: SBF - just like checking whether the wedding arrangements are all final, marriages fall into these three categories!

Six Kinds of Divorce in Muslim Law

What needs to be memorized: Talaq, Ila, Zihar, Lian, Khula, Mubarat

Mnemonic: "Teri Id Zabardast, Lekin Khana Mehnga"
(Your Eid is great, but the food is expensive)

🔗 The Breakdown:

  • Teri → Talaq (divorce by husband's pronouncement)
  • Id → Ila (divorce by vow of continence)
  • Zabardast → Zihar (divorce by injurious comparison)
  • Lekin → Lian (divorce by false charge of adultery)
  • Khana → Khula (divorce by wife with consideration)
  • Mehnga → Mubarat (divorce by mutual consent)

💡 Fun fact: Just like this sentence flows naturally in conversation, these six forms of divorce flow from husband-initiated to wife-initiated to mutual!

Forms of Talaq (Classification)

What needs to be memorized: Talaq-ul-Sunnat has two forms - Ahsan (most approved) and Hasan (approved); Talaq-ul-Biddat (disapproved/sinful)

Mnemonic: "SAH-B Formula" - Sunnat ke do bête Ahsan aur Hasan, aur Bad Biddat"
(Sunnat has two sons - Ahsan and Hasan, and the bad one is Biddat)

🔗 The Breakdown:

  • SSunnat (approved methods - the good family)
  • AAhsan (most proper - elder son, one pronouncement)
  • HHasan (proper - younger son, three pronouncements in three tuhrs)
  • BBiddat (improper/bad - the black sheep, triple talaq at once)

💡 Think: SAH is "sahi" (right) and B is "bad" - easy to remember which forms are approved and which aren't!

Grounds for Dissolution of Marriage by Wife (Dissolution of Muslim Marriage Act, 1939)

What needs to be memorized: 9 grounds - Whereabouts unknown (4 years), Neglect/No maintenance (2 years), Imprisonment (7 years), Failed marital obligations (3 years), Impotence, Insanity/Disease (2 years), Age (child marriage repudiation), Cruelty, Other recognized grounds

Mnemonic: "Wife Ne In Faltu Idiots se I Asked - Chhod do, OK?"
(Wife said to leave these useless people, OK?)

🔗 The Breakdown:

  • Wife → Whereabouts of husband unknown (4 years)
  • Ne → Neglect or failure to maintain (2 years)
  • In → Imprisonment (7+ years)
  • Faltu → Failed to perform marital obligations (3 years)
  • Idiots → Impotence
  • I (idiots) → Insanity (2 years) / leprosy / virulent venereal disease
  • Asked → Age - girl married before 15, repudiates before 18
  • Chhod → Cruelty (physical or mental)
  • OK → Other grounds recognized under Muslim law

💡 Pro tip: Notice the three "I"s (In, Idiots, I) represent three different grounds - Imprisonment, Impotence, and Insanity. The time periods (4, 2, 7, 3, 2 years) come with practice!

Types of Dower/Mehr

What needs to be memorized: Specified Dower (with two subtypes: Prompt and Deferred), Proper Dower (when amount not specified)

Mnemonic: "SP-PD: Shaadi mein Payment - Prompt ya Deferred; warna Proper dower"
(Payment in marriage - Prompt or Deferred; otherwise Proper dower)

🔗 The Breakdown:

  • Shaadi → Specified Dower (Mahr-i-Musamma - when amount is fixed)
    • Prompt → Prompt/Muajjal (payable immediately on demand)
    • Deferred → Deferred/Muwajjal (payable on divorce, death, or fixed date)
  • Payment (warna) → Proper Dower (Mahr-i-Mithl - when amount not specified, determined by court based on social status)

💡 Think of it like online shopping: SP means "Specified Price" with payment options Prompt (pay now) or Deferred (pay later). If price not specified, court decides the "Proper" amount!

Iddat Period (Waiting Period for Women)

What needs to be memorized: After Divorce (3 courses), After Death of husband (4 months 10 days), Pregnant woman (until delivery)

Mnemonic: "3-4-D: 3 cycles for Divorce, 4 months 10 days for Death, till Delivery for pregnant"

🔗 The Breakdown:

  • 33 menstrual courses (or 3 lunar months if no menstruation) - for Divorce
  • 44 months and 10 days - for Death of husband
  • D → Until Delivery of child - for pregnant women (whichever is longer)

💡 Memory trick: Divorce is shorter (3), Death requires longer mourning (4 months 10 days), and Delivery overrides everything for pregnant women!

Who is Entitled to Maintenance Under Muslim Law

What needs to be memorized: Wife, Children (sons till majority/daughters till marriage), Parents (if poor)

Mnemonic: "WCP - Wedding ke baad Care for Parents bhi"
(After wedding, also care for parents)

🔗 The Breakdown:

  • Wedding → Wife (during and after marriage under certain conditions)
  • Care → Children (sons until majority; daughters until marriage)
  • Parents → Parents (if poor and unable to maintain themselves)

💡 Remember: Muslim law emphasizes family responsibility - your wife, your children, and your parents (if they need it) - in that order of priority!

Essential Conditions for Wife's Right to Maintenance

What needs to be memorized: Valid Marriage, Submits to husband's authority, No Nushuz (disobedience/ill-conduct)

Mnemonic: "VSN - Very Simple Nikah = maintenance due"

🔗 The Breakdown:

  • Very → Valid Marriage (Sahih Nikah must exist)
  • Simple → Submits to husband's lawful authority / offers conjugal rights
  • Nikah → No Nushuz (not disobedient, no ill-conduct)

💡 Quick check: If the nikah is valid, wife submits to reasonable authority, and she's not engaged in misconduct - maintenance is her right!

Prohibitions in Marriage (Matrimonial Impediments)

What needs to be memorized: Three categories - Absolute/Permanent, Relative/Temporary, Directory

Mnemonic: "ARD - Arranged marriages check Relations and Documents"

🔗 The Breakdown:

  • Arranged → Absolute/Permanent prohibitions (consanguinity, affinity, fosterage - never allowed)
  • Relations → Relative/Temporary prohibitions (another man's wife, under iddat, etc. - temporary bar)
  • Documents → Directory prohibitions (without wali's consent, in Ihram, etc. - irregular but valid)

💡 Think: Just like families check everything before arranging a marriage - relations (blood), and documents (legal status) - Muslim law has these three levels of checking!
