Three Modes of Abetment (Section 107 IPC)

What needs to be memorized: Instigation, Conspiracy, Intentional Aid

Mnemonic: "Inspector Caught Accomplice"

🔗 The Breakdown:

  • InspectorInstigation (actively provoking/suggesting someone to commit offense)
  • CaughtConspiracy (agreement between two or more persons)
  • AccompliceAid (intentionally helping by act or omission)

Essential Elements of Abetment by Instigation

What needs to be memorized: Active Suggestion/Support, Intention to provoke, Actual instigation must occur

Mnemonic: "Suspect Intentionally Acted"

  • SuspectSuggestion/Support/Stimulation (active encouragement given)
  • IntentionallyIntention (mens rea - mental element to provoke)
  • ActedActual instigation (instigation must actually take place)

Essential Elements of Abetment by Conspiracy

What needs to be memorized: Agreement between persons, Object (illegal act or legal act by illegal means), Act or illegal omission must take place

Mnemonic: "All Organized Actions"

  • AllAgreement (between two or more persons)
  • OrganizedObject/Objective (must be illegal act OR legal act by illegal means)
  • ActionsAct or illegal omission (must take place in pursuance of conspiracy)

Essential Elements of Abetment by Aid

What needs to be memorized: Intentional aid, By act or illegal omission, Facilitation of the thing abetted

Mnemonic: "IAF" (Indian Air Force)

💡 Remember: Just like IAF helps and supports, abetment by aid is about helping the offender!

🔗 The Breakdown:

  • Indian → Intentional (aid must be intentional, not accidental)
  • Air → Act or illegal omission (help can be by doing or not doing)
  • Force → Facilitation (must facilitate/make easier the commission of offense)

Core Abetment Sections (107-109)

What needs to be memorized: Section 107 (Definition), Section 108 (Abettor), Section 109 (Punishment when act committed)

Mnemonic: "DAP lagao" (Apply DAP)

💡 Remember: Think of it as "Danda" (punishment) sequence - first define, then identify who, then punish!

🔗 The Breakdown:

  • D (107) → Definition of Abetment
  • A (108) → Abettor (who is an abettor)
  • P (109) → Punishment (when act abetted is committed - same as offender)

Important Distinction: Sections 109 vs 115

What needs to be memorized: Section 109 (when act IS committed - same punishment as offender), Section 115 (when act is NOT committed - specific punishment for abetment)

Mnemonic: "109 = Job Done, 115 = Job Incomplete"

💡 Think like this:

  • 109 → Act HO gaya (happened) → O in middle of 109 = job Over → Abettor gets SAME punishment as main offender
  • 115 → Act NAHI hua (didn't happen) → Two 1s standing apart (115) = disconnected/incomplete → Abettor gets SPECIFIC punishment for abetment only

Section 114 - Abettor Present at Offense

What needs to be memorized: When abettor is PRESENT when offense committed, punishment may be specifically provided

Mnemonic: "114 = One-One-Four = 1 aur 1 (one and one together) = Both Present"

💡 Remember: The two "1"s in 114 represent abettor and offender TOGETHER at crime scene - both present!

🔗 The Logic:

  • Section 114 → Two "1"s → Abettor + Offender = Both Present at scene
  • When present, law may provide ENHANCED punishment

Abetment vs Conspiracy - Key Difference

What needs to be memorized: Abetment requires some ACT towards commission; Conspiracy is complete by mere AGREEMENT

Mnemonic: "A-C ka farak yaad rakho" (Remember A-C difference)

🔗 The Breakdown:

  • Abetment → Action zaroori (Action necessary) → Some act/omission required
  • Conspiracy → Commitment kaafi (Commitment enough) → Just agreement is sufficient

💡 Extra Tip: Conspiracy under Section 120A is a SUBSTANTIVE offense (can be charged alone), but Abetment is NOT substantive (needs main offense)

When Abettor Liable for Different Act (Section 111)

What needs to be memorized: Abettor liable even if different act done, provided the act done was a PROBABLE CONSEQUENCE of abetment

Mnemonic: "111 = Teen ek jaise (Three ones alike) = Probable Path"

💡 Story to Remember: You instigate someone to slap a person, but they punch instead. You're still liable because punching is a PROBABLE consequence of instigation to hurt. The three "1"s in 111 show the connected path from instigation → probable → actual act.

🔗 Key Rule:

  • Different act done ≠ Abettor escapes
  • If different act was probable consequence → Abettor still LIABLE
  • Section 111 → All three "1"s connected → Shows connected liability
