💡 Application Rule: If all three = YES → Apportionment applies → Benefit aur Burden dono transferee ke paas jayenge proportionately!

Core Principle of Apportionment

What needs to be memorized: The fundamental maxim underlying the doctrine of apportionment

Latin Maxim: "Qui sentit commodum sentire debet et onus"

Simple Translation: "Benefit liya toh Burden bhi lena padega"

English Version: "He who takes the benefit must also bear the burden"

💡 Remember: This is the heart of Section 64, Transfer of Property Act. Jab property transfer hoti hai with an encumbrance (like mortgage), the transferee jo benefit le raha hai property ka, usko burden bhi proportionately bear karna hoga - unless contract specifically says otherwise.

Exception: Contract is King! Agar parties ne express ya implied agreement kar li hai to exclude apportionment, then this principle won't apply.
