FAQs on PPT - Consideration of Contract & Legality of Object - Business Law - B Com

1. What is the consideration of a contract?
Ans. The consideration of a contract refers to the value or benefit that each party to the contract receives or expects to receive from the agreement. It is an essential element of a valid contract and can be in the form of money, goods, services, or a promise to do or not do something.
2. What is the legality of object in a contract?
Ans. The legality of object in a contract refers to the requirement that the purpose or objective of the contract must be legal and not against public policy. If the object of a contract is illegal or against public policy, the contract is considered void or unenforceable.
3. What happens if a contract lacks consideration?
Ans. If a contract lacks consideration, it is generally considered to be incomplete and unenforceable. Both parties must provide something of value or benefit in order for a contract to be valid. Without consideration, there is no mutual exchange of promises or obligations, and the contract may be deemed void.
4. Can consideration be a nominal amount or something of little value?
Ans. Yes, consideration can be a nominal amount or something of little value. It is not necessary for consideration to be of substantial value as long as it is something of legal value. Courts generally do not concern themselves with the adequacy of consideration as long as there is a mutual exchange of promises or obligations between the parties.
5. What are some examples of illegal objects in contracts?
Ans. Examples of illegal objects in contracts include agreements to commit a crime, contracts that promote fraud or deception, contracts that violate government regulations or public policy, and contracts that involve illegal activities such as drug trafficking or human trafficking. It is important for the object of a contract to be lawful and not contrary to any laws or regulations in order for the contract to be enforceable.
