Initiating the process of removal of the President before the expiry of his term
The process of removal of the President before the expiry of his term is known as impeachment. Impeachment can be initiated by any Member of Parliament (MP) in either house of Parliament.
The process of impeachment is as follows:
1. Notice: A written notice of the proposal to impeach the President must be given to the Speaker of the Lok Sabha or the Chairman of the Rajya Sabha, depending on the house in which the notice is given.
2. Inquiry: The Speaker or the Chairman must then constitute a committee to investigate the charges against the President.
3. Motion: If the committee finds the charges to be true, a motion for the impeachment of the President can be introduced in either house of Parliament.
4. Passing the motion: The motion must be passed by a two-thirds majority of the members present and voting in each house of Parliament.
5. Sent to the other house: If the motion is passed in one house, it is then sent to the other house for consideration.
6. Joint sitting: If the motion is passed by both houses of Parliament, a joint sitting of both houses is held to vote on the motion.
7. Removal: If the motion is passed by a two-thirds majority of the members present and voting in the joint sitting, the President is removed from office.
