Digital Jurisprudence in India, in an AI Era

Why in News?

Even though Generative AI (GAI) stands as a transformative force, wielding power to revolutionise society in ground-breaking ways, existing legal frameworks and judicial precedents that have been designed for a pre-AI world may struggle to effectively govern this rapidly-evolving technology.

What is Generative Artificial Intelligence?

  • Definition: Generative Artificial Intelligence (GAI) focuses on creating new content, such as images, audio, and text, based on learned patterns and rules from existing data.
  • Key Models:
    • Generative Adversarial Networks (GANs): Can generate realistic images, such as synthetic faces.
    • Variational Autoencoders (VAEs): Another type of model used in GAI.

Initial Uses and Broader Perspective

  • Early Applications: Initially used for automating repetitive tasks in digital image and audio correction.
  • Broad View: Machine learning and deep learning are inherently generative processes and can be considered types of GAI.

Applications of Generative AI

  • Art and Creativity:

    • Helps artists explore new ideas and push the boundaries of traditional art.
    • Examples:
      • DeepDream Generator: Creates surreal, dream-like images.
      • DALL·E2: Generates new images from text descriptions.
  • Music:

    • Assists musicians and producers in exploring new sounds and styles.
    • Examples:
      • Amper Music: Creates musical tracks from pre-recorded samples.
      • AIVA: Composes original music in various genres.
  • Computer Graphics:

    • Generates new 3D models, animations, and special effects for movies and games.
  • Healthcare:

    • Improves medical diagnoses and treatments by generating new medical images and simulations.
  • Manufacturing and Robotics:

    • Optimizes manufacturing processes, enhancing efficiency and quality.

Significance for India

  • AI Employment: Estimated at about 416,000 professionals.
  • Growth Rate: Sector growing at an estimated 20-25%.
  • Economic Impact: AI expected to contribute an additional USD 957 billion to India’s economy by 2035.

Concerns Related to Generative Artificial Intelligence (GAI)

  • Accuracy:

    • Ensuring high-quality and accurate outputs from GAI is challenging.
    • Advanced generative models are required to accurately capture patterns and rules from data.
  • Partisan GAI Models:

    • GAI models trained on biased data may produce biased outputs.
    • This can lead to discrimination and reinforce existing societal biases.
  • Privacy:

    • Training GAI models requires large amounts of data, including personal and sensitive information.
    • There is a risk of this data being used unethically, such as for targeted advertising or political manipulation.
  • Responsibility:

    • GAI can generate new content, including fake news or malicious content.
    • Determining responsibility for harmful outputs poses ethical dilemmas.
  • Automation and Job Displacement:

    • GAI has the potential to automate many processes, leading to job displacement.
    • This raises ethical questions about using AI for job displacement and its impact on workers and society.

Way Forward for Generative Artificial Intelligence (GAI)

  • Research and Development:

    • More research is needed to enhance the accuracy and reliability of GAI models.
    • Development of new algorithms and models that are transparent and accountable for their outputs is crucial.
  • Regulations and Standards:

    • Implement regulations to ensure responsible and ethical use of GAI.
    • Establish guidelines for data privacy, bias, and accountability.
    • Ensure GAI is used for societal benefit and not to the detriment of individuals or groups.
  • Collaboration:

    • Foster collaboration among industry, government, academia, and civil society.
    • Joint efforts are essential to ensure responsible and ethical use of GAI.
  • Ethical and Unbiased Data:

    • Ensure the data used for training GAI models is ethical and unbiased.
    • Respect the privacy of individuals and avoid reinforcing existing biases in data collection and usage.
