Ordinance, 2020, which amended A.P. Panchayat
Raj Act, 1994.
• In pursuance of the 2020 ordinance, the
Governor also issued the A.P. Panchayat Raj
(Salaries and Allowances, Conditions of
Service and Tenure of SEC) Rules, 2020.
• Actions prematurely terminated the tenure of

ordinance was actuated by fraud on power.

his discretionary power
• In clause 2, the expression ‘conditions of
service and tenure of office’ does not include
‘appointment’ – ‘on appointment and holding of
post of SEC, the conditions of service and
tenure of office may be as per any law made
by State legislature or as determined by the
Rules made by the Governor’.
