Reasons for Independence

  • Separation of Powers: The Indian Constitution has provided for a clear separation of powers between the legislature, executive, and judiciary. This means that each branch of government has its own set of powers and responsibilities, and there is no interference from one branch into the affairs of the other.

  • Appointment and Tenure of Judges: The appointment of judges to the higher judiciary, such as the Supreme Court and High Courts, is done by the President of India on the recommendation of a collegium of judges. This ensures that only the most competent and qualified individuals are appointed to these positions. Judges are also given a tenure of several years to ensure their independence from political pressure.
