National Emergency and Executive Power

During a national emergency, the Constitution of India grants certain extraordinary powers to the Centre to deal with the situation effectively. One such power is the extension of executive power to direct any state with regard to the manner in which its executive power is to be exercised. This power is mentioned in Article 353 of the Constitution.

Executive Power of the Centre

Under normal circumstances, the Centre can give executive directions to a state only on certain specified matters. These matters are mentioned in Article 256 of the Constitution and include issues related to the maintenance of law and order, the protection of the rights of minorities, the promotion of welfare of the people, and the prevention of any danger to the unity and integrity of India.

This is done to ensure that the state machinery is effectively utilized to deal with the emergency situation. The Centre can also take direct control of the state machinery if it feels that the state government is not able to handle the situation appropriately.
