  • Freedom to Move Freely Throughout the Territory of India:
    • Article 19(1)(d) of the Indian Constitution entitles every citizen to move freely throughout the territory of the country. Hence, statement 1 is correct.
    • This right is protected against only state action and not private individuals.
    • Moreover, it is available only to the citizens and to shareholders of a company but not to foreigners or legal persons like companies or corporations, etc.

      • The second dimension is dealt by Article 21 (Right to life and personal liberty).

Consider the following statements:1. Article 19(1)(d) of the Indian Co...
Explanation:

Article 19(1)(d) of the Indian Constitution:
- Article 19(1)(d) of the Indian Constitution guarantees the right to move freely throughout the territory of India to every citizen.
- This fundamental right allows individuals to travel and reside in any part of the country without any restrictions.

Restrictions on Free Movement:
- However, this right is not absolute and can be restricted under certain circumstances.
- One such circumstance is to protect the interests of the general public. For example, during times of national emergency or to prevent public disorder, the government may impose restrictions on the movement of people.
- Another circumstance where free movement can be restricted is for the protection of the interests of any scheduled tribe. This is important to safeguard the cultural, social, and economic rights of these marginalized communities.

Correct Answer:
- Both statements 1 and 2 are correct.
- While Article 19(1)(d) guarantees the right to move freely, this right can be limited in order to protect the interests of the general public and scheduled tribes.
- It is essential to balance individual rights with the broader interests of society to ensure harmony and social cohesion.
