Constitutional Rights in India

The Constitution of India provides various fundamental rights to its citizens. Two of these fundamental rights are discussed below:

Right to Freedom of Movement

- The right to freedom of movement is enshrined under Article 19(1)(d) of the Constitution of India.
- It entitles every citizen to move freely throughout the territory of the country without any restrictions.
- However, this right is subject to reasonable restrictions imposed by the State in the interest of public order, morality, and the security of the State.
- Therefore, this statement is partially correct.

Right to Practise Any Profession or Occupation

- The right to practise any profession or occupation is enshrined under Article 19(1)(g) of the Constitution of India.
- This right allows all citizens to carry on any occupation, trade, or business of their choice.
- However, this right is also subject to reasonable restrictions imposed by the State in the interest of the general public.
- Therefore, this statement is correct.

Conclusion

Based on the above discussion, it can be concluded that statement 2 is correct while statement 1 is only partially correct.

  • Right to freedom of movement entitles every citizen to move freely throughout the territory of the country. The grounds of imposing reasonable restrictions on this freedom are two, namely, the interests of general public and the protection of interests of any scheduled tribe. The entry of outsiders in tribal areas is restricted to protect the distinctive culture, language, customs and manners of scheduled tribes and to safeguard their traditional vocation and properties against exploitation.
  • All citizens are given the right to practise any profession or to carry on any occupation, trade or business. This right is very wide as it covers all the means of earning one’s livelihood.
