  • Recently the Central government has promulgated two ordinances that would allow the Centre to extend the tenures of the directors of the Central Bureau of Investigation and the Enforcement Directorate from two years to up to five years.
  • The Central Bureau of Investigation traces its origin to the Special Police Establishment (SPE), 1941. Later the Delhi Special Police Establishment Act was brought into force in 1946 and the CBI's power to investigate cases is derived from this Act.
  • The Directorate of Enforcement was established in the year 1956 with its Headquarters at New Delhi. It is responsible for enforcement of the Foreign Exchange Management Act, 1999 (FEMA) and certain provisions under the Prevention of Money Laundering Act. The Directorate is under the administrative control of Department of Revenue for operational purposes; the policy aspects of the FEMA, its legislation and its amendments are within the purview of the Department of Economic Affairs. Hence, statement 1 is not correct.
  • The chiefs of the Central agencies currently have a fixed two-year tenure, but can now be given three annual extensions. Hence, statement 2 is correct.
  • While the change in tenure of the CBI Director was effected by amending the Delhi Special Police Establishment Act, 1946, the changes to the tenure of the ED Director was brought in by amending the Central Vigilance Commission Act, 2003.
