According to Mohammedan Law, marriage (nikkah) is a civil contract, the object whereof is to legalise cohabitation and the procreation of children. The institution of marriage is recognised in Islam as the basis of society. It serves the nature of both- a contract and a sacred covenant. The age of attaining puberty is 15 years according to applicable personal laws in Islam. It observed that 15 years is the age of puberty of a Muslim female, and on her own will she can consent and marry a person of her choice after attaining the age. Such a marriage would not be void in terms of Section 12 of the Prohibition of Child Marriage Act 2006. For a valid Islamic marriage, the following requisites must be fulfilled:
  • The parties must be in a capacity to marry.
  • There must be a proper offer (Ijab) and an appropriate acceptance of such offer (Qubool).
  • There should be the presence of a free consent.
  • It should be devoid of legal disability.
Q. A 16-year-old Muslim girl engages in a consensual sexual relationship with a Muslim guy, age 25. The man is later the subject of a complaint from the girl's family, who accuses him of having committed a crime. The man contends that their connection is consensual and the girl is capable of entering into a marriage contract under Muslim personal law. Decide?
  • a)
The man's claim is unfounded because Muslim personal law specifies a consent age of 18 or older.
  • b)
The man's claim is persuasive because Muslim personal law permits girls over 15 to have consenting sexual relations.
  • c)
The man's claim is untrue because Muslim personal law forbids having sex outside of a recognized marriage.

If the girl's family consents to their relationship in accordance with Muslim personal law, the man's claim is true.
