The monistic theory maintains that the subjects of two systems of law, i.e. international law and municipal law are essentially one. The monistic theory asserts that international law and municipal law are fundamentally the same in nature, and arise from the same science of law, and are manifestations of a single conception of law. The followers of this theory view international law and municipal law as part of a universal body of legal rules binding all human beings, collectively or singly. In a monist system, international law does not need to be incorporated into domestic law because international law immediately becomes incorporated in domestic legal system upon ratification of an international treaty. According to this theory, domestic law is subordinate to international law. The Statute of the International Criminal Court, therefore, can be directly applied and adjudicated in national courts according to the monistic theory. According to dualism theory, international law and municipal law represent two entirely distinct legal systems, i.e. international has an intrinsically different character from that of municipal law. International law is not directly applicable in the domestic system under dualism. First, international law must be translated into State legislation before the domestic courts can apply it. For example, under dualism, ratification of the Statute of the International Criminal Court is not enough-it must be implemented through State legislation into the domestic system. Most States and courts presumptively view national and international legal systems as discrete entities and routinely discuss in dualist fashion incorporation of rules from one system to the other.Q. In his historic address to the Parliament of the World's Religions in Chicago in 1893, Swami Vivekananda declared, "I am proud to belong to a nation which has sheltered the persecuted and the refugees of all religions and all nations of the earth." It is ironical that a political party which conspicuously proclaims its allegiance to Swami Vivekananda has restricted by law, about 127 years later, citizenship to people on the grounds of both religion and nation.Looking back, it is pertinent to ask why Jawaharlal Nehru, an international statesperson and a leading moral voice in the community of nations, refused to sign the 1951 Refugee Convention relating to the Status of Refugees.Scholars suggest that whereas he was committed to the principles enshrined in the Convention, he was unwilling to legally bind the country to its obligations.The Convention first defines refugees as persons fleeing persecution on grounds of race, religion, nationality, social group or political opinion. Refugees get legal rights, most important of which are "non-refoulement", which prevents states from sending back refugees to persecution in their home countries. They also get secondary rights, such as to education, work and property.India needs to bring in a refugee law which conforms to international conventions. This would, first, recognise eligible undocumented immigrants as refugees, based on evidence determined by due process of their persecution in their home countries. This would also assure them a set of binding rights. The most important of these is the guarantee that they would not be forced to return to the conditions of persecution, threatening their lives and liberty, which they escaped. The second is that they would be assured lives of dignity within India, with education, health care and livelihoods. Only then would India become the country which Swami Vivekananda was so proud of: a haven to the persecuted of the world, untainted by discrimination based on religion or nation.Q. The preamble of the Vienna Convention states that “the rules of customary international law continue to govern matters not expressly regulated by the provisions of the present Convention”. Article 36 of the Convention expressly regulates the question of consular access to, and communication with, nationals of the sending State and makes no exception with regard to cases of espionage. Therefore, Article 36 of the Convention, and not customary international law, governs the matter at hand in the relations between the Parties.Point (vi) of the 2008 Agreement provides that “In case of arrest, detention or sentence made on political or security grounds, each side may examine the case on its merits”. It also recalls that, in the preamble of the Agreement, the Parties declared that they were “desirous of furthering the objective of humane treatment of nationals of either country arrested, detained or imprisoned in the other country”. The Court is of the view that point (vi) of the Agreement cannot be read as denying consular access in the case of an arrest, detention or sentence made on political or security grounds.(1). It has already found that Pakistan acted in breach of its obligations under Article 36 of the Vienna Convention:(i) by not informing Mr. Jadhav of his rights under Article 36, paragraph 1 ( b);(ii) by not informing India, without delay, of the arrest and detention of Mr. Jadhav; and(iii) by denying access to Mr. Jadhav by consular officers of India, contrary to their right, inter alia, to arrange for his legal representation.Pakistan is under an obligation to cease those acts and to comply fully with its obligations under Article 36 of the Vienna Convention.
