Constitutional Provisions on Election of President and Vice-President

Article 54 of the Indian Constitution provides for the election of the President of India. Article 55 specifies the manner of election of the President. Similarly, Article 63 provides for the election of the Vice-President of India.

Regulation of Election by Parliament

According to Article 327 of the Constitution, Parliament may make provisions with respect to all matters relating to or connected with the election of a President or Vice-President. This means that Parliament has the power to regulate the conduct of the election, including the qualifications of candidates, the mode of election, and the procedure for resolving disputes.

This provision also gives Parliament the power to amend the Presidential and Vice-Presidential Elections Act, 1952, which lays down the detailed rules and procedures for conducting the election.

Role of Election Commission

Article 324 of the Constitution empowers the Election Commission of India (ECI) to conduct elections to the office of the President and Vice-President. The ECI is responsible for overseeing the entire election process, including the preparation of electoral rolls, the conduct of the election, and the counting of votes.

In case of any doubts or disputes arising out of the election, the ECI is also responsible for resolving them. Its decision in such matters is final.
