Original Jurisdiction of Supreme Court

The original jurisdiction of the Supreme Court refers to the types of cases that can be filed directly in the Supreme Court without going through any lower court. The Constitution of India has provided for the following types of cases that fall under the original jurisdiction of the Supreme Court:

Disputes between Union and States

One of the most important types of cases that fall under the original jurisdiction of the Supreme Court is the dispute between the Union and States. Article 131 of the Constitution provides that the Supreme Court shall have the exclusive jurisdiction to hear and determine any dispute between the Union and one or more States or between two or more States.

Disputes amongst States

Another important type of case that falls under the original jurisdiction of the Supreme Court is the disputes amongst States. Article 131 also provides that the Supreme Court shall have the exclusive jurisdiction to hear and determine any dispute between two or more States.

Centre and any state or states on one side and one or more states on the other

Article 131 also provides that the Supreme Court shall have the exclusive jurisdiction to hear and determine any dispute arising out of any pre-constitution treaty, agreement, covenant etc., or any other treaty, agreement, covenant, engagement, sanad or other similar instrument which was entered into by any Ruler of an Indian State and to which the Government of the Dominion of India or any of its predecessor Governments was a party.

Inter-State water disputes

Another type of case that falls under the original jurisdiction of the Supreme Court is inter-state water disputes. The Parliament has enacted the Inter-State River Water Disputes Act, 1956, which provides for the adjudication of disputes relating to waters of inter-state rivers and river valleys. The Supreme Court has the original jurisdiction to hear and determine any such dispute.

Conclusion

In conclusion, the original jurisdiction of the Supreme Court is limited to certain types of cases that are of great importance to the Union and the States. The Supreme Court has the exclusive jurisdiction to hear and determine these cases, and its decisions are final and binding on all parties.
