Which of the following come(s) underthe exclusive original jurisdictio...
Option (b) is correct:
As a federal court, the Supreme Court decides the disputes between different units of the Indian Federation. More elaborately, any dispute:
(a) Between the Centre and one or more states; or
(b) Between the Centre and any state or states on one side and one or more other states on the other side; or
(c) Between two or more states. In the above federal disputes, the Supreme Court has exclusive original jurisdiction.
  • The Supreme Court is empowered to issue writs for the enforcement of the fundamental rights of an aggrieved citizen. In this regard, the Supreme Court has original jurisdiction in the sense that an aggrieved citizen can directly go to the Supreme Court, not necessarily by way of appeal. However, the writ jurisdiction of the Supreme Court is not exclusive.
  • The high courts are also empowered to issue writs for the enforcement of the Fundamental Rights. Original jurisdiction of the Supreme Court does not extend to a dispute arising out of any pre-Constitution treaty, agreement, covenant, engagement, sanad or other similar instrument.
  • It decides the disputes regarding the election of the president and the vice- president. In this regard, it has the original, exclusive and final authority.

Which of the following come(s) underthe exclusive original jurisdictio...
Exclusive Original Jurisdiction of the Supreme Court
The Supreme Court of India has exclusive original jurisdiction in specific matters as defined by the Constitution. The question requires identifying which options fall under this category.
1. Writ Jurisdiction
- Writs can be issued by the Supreme Court under Article 32, but this is not exclusive original jurisdiction. It can also be exercised by High Courts under Article 226.
2. Dispute Between Centre and a State
- This falls under the exclusive original jurisdiction of the Supreme Court as per Article 131. It allows the Supreme Court to adjudicate disputes between different government entities.
3. Dispute Related to Election of the President
- This is not under exclusive original jurisdiction. Such disputes are generally resolved by the Election Commission and can be challenged in the Supreme Court, but the jurisdiction is not exclusive.
4. A Dispute Arising Out of Any Pre-Constitution Treaty
- This does not fall under exclusive original jurisdiction; these matters can be addressed in various courts and are not specifically reserved for the Supreme Court.
Conclusion
Based on the analysis:
- The only options that fall under the exclusive original jurisdiction of the Supreme Court are 2 (Dispute between Centre and a State) and 3 (Dispute related to election of the President).
Thus, the correct answer is option B (2 and 3 only).
