  • Parliamentary privileges are certain rights and immunities enjoyed by members of Parliament, individually and collectively, so that they can “effectively discharge their functions”. When any of these rights and immunities are disregarded, the offence is called a breach of privilege and is punishable under law of Parliament.
  • A notice is moved in the form of a motion by any member of either House against those being held guilty of breach of privilege. Each House also claims the right to punish as contempt actions which, while not breach of any specific privilege, are offences against its authority and dignity.
  • The Speaker/RS chairperson is the first level of scrutiny of a privilege motion. The Speaker/Chair can decide on the privilege motion himself or herself or refer it to the privileges committee of Parliament.

Consider the following statements regarding Privilege motion. Parliame...
< b="" />Explanation:< />

Parliamentary privileges are certain rights and immunities enjoyed by members of Parliament, individually and collectively, so that they can effectively discharge their functions. These privileges are essential to maintain the dignity and authority of Parliament and to enable its members to carry out their responsibilities without fear of interference or obstruction. Some of the privileges include freedom of speech, freedom from arrest in civil cases, and exemption from jury service.

A notice is moved in the form of a motion by any member of either House against those being held guilty of a breach of privilege. This notice is known as a privilege motion. The motion can be moved against any individual or authority, including the President, Prime Minister, or any other member of Parliament. The purpose of a privilege motion is to protect the rights and privileges of the members of Parliament and to ensure that they can carry out their duties without any hindrance.

The leader of the house, who is usually the Prime Minister or the Leader of the Opposition, is the first level of scrutiny of a privilege motion. The leader of the house has the power to accept, reject, or refer the motion to the Speaker for further consideration. If the motion is accepted, it is then referred to the Privileges Committee, which examines the matter in detail and submits a report to the house. The house then decides on the course of action, which may include reprimanding the guilty party, demanding an apology, or recommending further action.

Therefore, all three statements are correct:

1. Parliamentary privileges are certain rights and immunities enjoyed by members of Parliament, individually and collectively, so that they can effectively discharge their functions.
2. A notice is moved in the form of a motion by any member of either House against those being held guilty of a breach of privilege.
3. The leader of the house is the first level of scrutiny of a privilege motion.
