Appointment Procedure of High Court Judges:
The appointment of High Court judges in India is governed by Article 217 of the Constitution. The procedure for appointment of judges is as follows:
1. Chief Justice of the High Court:
The Chief Justice of the High Court is appointed by the President of India in consultation with the Chief Justice of India and the Governor of the respective state. He is appointed from among the judges of the High Court or from among the judges of other High Courts.
2. Appointment of Judges:
The other judges of the High Court are appointed by the President of India in consultation with the Chief Justice of India, the Chief Justice of the High Court, and the Governor of the respective state. The appointment is made from among the advocates who are eligible to be appointed as judges of the High Court or from among the judges of other High Courts.
3. Role of High Court Judges:
The High Court judges have no role in the appointment of judges. They are only consulted by the President of India in the appointment procedure.
4. Role of State Government:
The state government has no role in the appointment of judges. However, the Governor of the respective state is consulted in the appointment procedure.
Therefore, both statements given in the question are correct. The Chief Justice of the High Court is appointed from outside the state and there is no role of High Court judges or state government in the appointment of judges.
