The Constitution provides for the abolition or creation of legislative councils in states. Accordingly, the Parliament can abolish a legislative council (where it already exists) or create it (where it does not exist), if the legislative assembly of the concerned state passes a resolution to that effect. Such a specific resolution must be passed by the state assembly by a special majority, that is, a majority of the total membership of the assembly and a majority of not less than two-thirds of the members of the assembly present and voting.

Statement 1: The Constitution provides for the abolition or creation of legislative councils in states.

This statement is correct. Article 169 of the Constitution of India provides for the creation or abolition of legislative councils in states. According to this article, if a state wants to establish a legislative council, it can do so by passing a resolution to that effect in the state assembly. Similarly, if a state wishes to abolish the legislative council, it can do so by passing a resolution in the assembly.

Statement 2: The Parliament can abolish a legislative council if the legislative assembly of the concerned state passes a resolution to that effect.

This statement is also correct. According to Article 169 of the Constitution, if the legislative assembly of a state passes a resolution by a majority of the total membership of the assembly and by a majority of not less than two-thirds of the members present and voting, the Parliament may pass a law to abolish the legislative council of that state.

Statement 3: Such a specific resolution must be passed by the state assembly by a simple majority.

This statement is incorrect. As mentioned in statement 2, the resolution passed by the state assembly to abolish the legislative council must have a majority of the total membership of the assembly and a majority of not less than two-thirds of the members present and voting. It requires a special majority rather than a simple majority.
