  • An Act to establish an effective system for the protection of plant varieties, the rights of farmers and plant breeders and to encourage the development of new varieties of plants. It became the world's only IPR legislation on plant varieties that recognized and protected the rights of both breeders and farmers maintaining traditional land races and to encourage the development of new varieties of plants. So, Statement 1 is correct.
  • Any plant breeder or researcher can use a registered variety for conducting experiments and research or as an initial source of genetic material (parent) to develop another variety. This is so long as the protected variety isn't used as a parent repeatedly for the production of commercial seed, which requires the prior authorization of the original breeder/farmer. So, Statement 2 is correct.
  • As per the provision of Section 39(l) (iv) of the PPVFR Act 2001 entitles farmers can save, use, sow, re- sow, exchange, and share or sell their produce (including seed) from a protected variety. They do not resort to branding or packaging the variety for commercial purposes. At the same time, breeders (including farmers as plant breeders) have exclusive rights for the commercial production, sale, marketing, distribution and export of their protected varieties. So, Statement 3 is not correct.
