Principle:Nothing, which is not intended to cause death, is an offence...
Of course the answer is A. The first line itself says a 'fake' doctor. Which means he is not authorised to operate, yet he decided to treat a patient. This is not allowed by the law. Only a trained professional is permitted, mind you, after he/she has obtained a licence, to operate upon a patient. Hence the answer will be A, the man is liable for murder.

Principle:Nothing, which is not intended to cause death, is an offence...
Principle:
According to the principle mentioned, nothing which is not intended to cause death is an offense if the harm caused is for the benefit of the person who has given consent. The harm caused should be done in good faith and the person should have given express or implied consent to suffer or take the risk of that harm.

Facts:
A fake doctor operated on a man for internal piles using an ordinary knife. Unfortunately, the man died due to hemorrhage.

Answer:
The correct answer is option 'A': The doctor is guilty of murder.

Explanation:
The principle states that no offense is caused if the harm is not intended to cause death and if the person for whose benefit it is done has given consent. However, there are certain exceptions to this principle. In this case, the doctor is not a qualified professional and is a fake doctor. Operating on someone without proper medical knowledge and qualifications is considered a reckless and negligent act.

Death caused by a rash and negligent act:
The doctor, in this case, performed a surgical procedure using an ordinary knife instead of the appropriate medical instruments. This act shows a lack of skill, knowledge, and proper medical judgment. Operating on a person without the necessary expertise and using improper instruments can lead to serious complications and, in this case, resulted in the man's death due to hemorrhage. Such an act can be deemed as a rash and negligent act.

Murder:
Murder is the intentional killing of a person with malice aforethought. In this case, although the doctor did not intend to cause the man's death, the act of performing a surgical procedure without proper qualifications and using an ordinary knife shows a reckless disregard for the man's life. The doctor's actions can be considered as a clear case of gross negligence, which led to the man's death. Therefore, the doctor can be held guilty of murder.

Conclusion:
Considering the facts and applying the principle, it is evident that the doctor is guilty of murder due to the reckless and negligent act of operating on the man without proper qualifications and using an ordinary knife, which resulted in his death.
