Law on Contesting in Multiple Lok Sabha Constituencies in India
There is no law in India that restricts a candidate from contesting in one Lok Sabha election from three constituencies. However, the Election Commission of India has issued guidelines regarding this matter. Below are some important points to consider:
Election Commission Guidelines
- A candidate can contest from only one Lok Sabha constituency in a general election.
- If a candidate files nomination from more than one constituency, he/she will have to choose only one constituency to contest from before the last date of withdrawal of nominations.
- If a candidate is contesting from more than one constituency and wins in both, he/she will have to vacate one of the seats within 14 days of the declaration of the result.
- If a candidate fails to choose one constituency to contest from before the last date of withdrawal of nominations, all nominations filed by him/her will be deemed to have been rejected.
Arguments for and against Contesting in Multiple Constituencies
The practice of contesting in multiple constituencies has been criticized by some as it is seen as an attempt by candidates to increase their chances of winning and spreading themselves thin across multiple constituencies. It is also seen as a waste of resources and time as candidates have to campaign in multiple constituencies simultaneously.
