The demand for a constituent assembly was accepted for the first time by the British through their ‘August offer’ of 1940. Eventually, a constituent assembly was established under the provisions of the Cabinet Mission plan.
Facts about the Constituent Assembly: x Each province and princely state (or group of states in the case of small states) were to be allotted seats in proportion to their respective population. Roughly, one seat was to be allotted for every million population. Seats allocated to each British province were to be divided among the three principal communities–Muslims, Sikhs, and General (all except Muslims and Sikhs), in proportion to their population. Hence statement 1 is not correct.
The chairman of the Union Constitution Committee was Jawahar Lal Nehru while the Provincial constitution committee was presided by S Patel. Hence statement 2 is not correct.
Dr. Rajendra Prasad was elected as the President of the Assembly. Similarly, both H.C. Mukherjee and V.T. Krishnamachari were elected as the Vice-Presidents of the Assembly. In other words, the Assembly had two Vice-Presidents. Hence statement 3 is not correct.
Sir B.N. Rau, the Constitutional Advisor to the Constituent Assembly, recommended that the rights of an individual should be divided into two categories–justiciable and non-justiciable, which was accepted by the Drafting Committee. Consequently, the Fundamental Rights, which are justiciable in nature, are incorporated in Part III and the Directive Principles, which are nonjusticiable in nature, are incorporated in Part IV of the Constitution. Hence statement 4 is correct.
