Three Fold Distribution of Legislative Power between Union Government and State Government


The Constitution of India provides for a three-fold distribution of legislative power between the Union Government and State Governments. The three lists under the Seventh Schedule of the Constitution, namely Union List, State List, and Concurrent List, describe the scope of legislative power of the Union Government and State Governments.


Union List



  • The Union List specifies a range of subjects over which the Union Government has exclusive power to legislate.

  • There are a total of 100 subjects in the Union List, including defence, foreign affairs, banking, currency, atomic energy, etc.

  • The Union Government has a greater say in these subjects as they are of national importance and require uniformity in laws across the country.



State List



  • The State List specifies the subjects over which the State Governments have exclusive power to legislate.

  • There are a total of 61 subjects in the State List, including public order, police, agriculture, health, land, etc.

  • The State Governments have greater control over these subjects as they are more local in nature and require laws to cater to the specific needs of individual states.



Concurrent List



  • The Concurrent List specifies the subjects over which both the Union Government and State Governments have the power to legislate.

  • There are a total of 52 subjects in the Concurrent List, including education, forests, marriage, adoption, etc.

  • Both the Union Government and State Governments can make laws on these subjects, but in case of a conflict, the law made by the Union Government prevails.



The three-fold distribution of legislative power between the Union Government and State Governments ensures that both the Union and States have the authority to make laws on subjects that are important to them. This distribution of power helps in maintaining a balance of power between the Union Government and State Governments, ensuring that the interests of both are protected.
