PRINCIPLE: Everybody is under a legal obligation to take reasonable ca...
Explanation:

The principle states that a person is under a legal obligation to take reasonable care to avoid an act or omission that can foreseeably injure his neighbour. The neighbour, for this purpose, is any person whom he should have in his mind as likely to be affected by his act. In this case, Krishnan, while driving a car at high speed, knocked down a cyclist. The cyclist died on the spot, and Lakshmi, a pregnant woman passing by, suffered from nervous shock, leading to abortion. The question is whether Krishnan is liable for damages claimed by Lakshmi or not.

Option A: Krishnan will be liable because he owed a duty of reasonable care to everybody on the road, including Lakshmi.

Option B: Krishnan will not be liable because he could not have foreseen Lakshmi suffering from nervous shock as a result of his act.

Option C: Krishnan will be liable to Lakshmi because he failed to drive carefully.

Option D: None of the above.

Correct Answer: Option B.

Explanation:

Krishnan cannot be held liable for damages claimed by Lakshmi because he could not have foreseen her suffering from nervous shock as a result of his act. Krishnan did not owe a duty of care to Lakshmi since there was no reason for him to foresee such an eventuality. Lakshmi was not a direct victim of Krishnan's negligent act, and her injury was not a foreseeable consequence of Krishnan's act. Therefore, Krishnan cannot be held liable for Lakshmi's damages.
