Consider the following statements regarding Biodiversity Heritage Site...
Statement 1: Only the Central Government may notify areas of biodiversity importance as BHS.
This statement is incorrect. According to the Biological Diversity Act, 2002, both the Central and State Governments have the authority to notify areas of biodiversity importance as Biodiversity Heritage Sites (BHS). The Act empowers the State Governments to identify and notify such sites within their respective territories. This allows for a decentralized approach in recognizing and conserving areas of biodiversity importance, as different states may have unique ecological characteristics and priorities.

Statement 2: The State Government, in consultation with the Central Government, may frame rules for the management and conservation of BHS.
This statement is correct. As per the Biological Diversity Act, 2002, the State Government, in consultation with the Central Government, has the authority to frame rules for the management and conservation of Biodiversity Heritage Sites. This ensures a coordinated and collaborative approach between the Central and State Governments in developing effective management strategies for the conservation of these sites.

Explanation:
The Biological Diversity Act, 2002 provides a legal framework for the conservation, sustainable use, and equitable sharing of benefits arising out of the utilization of biological resources. Under this Act, Biodiversity Heritage Sites (BHS) are designated as areas of biodiversity importance. These sites are recognized for their unique ecological, biodiversity, and cultural values.

The Act enables both the Central and State Governments to play a role in the identification, notification, and management of Biodiversity Heritage Sites. While the Central Government has the authority to notify such sites, the State Governments can identify and propose areas within their jurisdiction for notification as BHS.

Once a site is recognized as a Biodiversity Heritage Site, the State Government, in consultation with the Central Government, can frame rules for the management and conservation of the site. This may include measures for the protection of biodiversity, restoration of ecosystems, regulation of activities, and promotion of sustainable use practices.

By involving both the Central and State Governments in the process, the Act ensures a collaborative approach towards biodiversity conservation. This allows for the integration of local knowledge, priorities, and expertise in the management of Biodiversity Heritage Sites, leading to more effective conservation outcomes.

In conclusion, statement 1 is incorrect as both the Central and State Governments have the authority to notify areas of biodiversity importance as BHS. Statement 2 is correct as the State Government, in consultation with the Central Government, can frame rules for the management and conservation of BHS.
